Dear Members,
RE: MEASURES TO DETECT AND PREVENT TOUTING (“ULAT PEGUAM”) ACTIVITIES AT COURT PREMISES IN THE STATE OF PERAK
The Perak Bar wishes to bring to the attention of all Members the attached letter from the Director of the Perak State Courts concerning measures implemented by the Perak State Courts to detect and prevent touting (“ulat peguam”) activities at court premises throughout the State of Perak.
The Perak State Courts have adopted a firm position against such activities and have taken steps to address the presence of individuals identified as actively engaging in touting within court premises. In particular, the Court has obtained details of the individuals concerned and has directed that they be barred from entering any court premises in the State of Perak, unless their attendance is required for a legitimate purpose in connection with court proceedings, such as where they are an accused person (OKT), a witness or otherwise required to attend court in a relevant capacity.
To ensure the effective implementation of these measures, the Court has directed the appointed security personnel to take the following steps:
1. Identification and Monitoring of Individuals Involved in Touting
Security personnel are required to identify and monitor individuals who have been identified by the Court or are suspected of engaging in touting activities within court premises, based on information and particulars made available to them.
2. Dissemination of Information to Security Personnel
The relevant identifying particulars, including reports and photographs where available, are to be communicated to security personnel on duty to facilitate the identification of such individuals at court entrances and within court premises.
3. Maintenance of Visitor Registration Records
Security personnel must ensure that visitor registration records, including names, identity card numbers and other relevant attendance particulars are properly and systematically maintained in accordance with the applicable security procedures.
4. Appropriate Preventive Measures
In accordance with the Court’s directions, appropriate measures are to be taken to prevent the individuals concerned from entering court premises, subject to any legitimate requirement for their attendance in connection with court proceedings and the applicable procedures.
It is further indicated that police reports will be lodged against individuals who persist in engaging in touting activities notwithstanding these measures. Members are therefore advised to take note of the Court’s position and the enforcement action that may follow if such activities continue. Kindly take note that action will also be taken against Members of the Bar if it is found that any of these touts are employed directly by a particular Member.
In light of the foregoing, all Members are requested to take note of the measures adopted by the Perak State Courts and to remain vigilant against touting activities. Any relevant information or concerns may be brought to the attention of the appropriate Court management, or to us for further consideration and action.
Perak Bar supports the efforts of the Perak State Courts to address touting activities and to safeguard the integrity of the legal profession and the administration of justice. The cooperation of all Members in this regard is greatly appreciated.
Thank you.
Yours faithfully,
