Dear Members of Perak Bar / Pupils in Chambers,

The Government of Malaysia has on the 20-05-2021 implemented the Enhanced Movement Control Order [ EMCO ] in several districts in Perak with effect from 22-5-2021 to 4-6-2021.  The affected districts are Hulu Perak, Kinta, Muallim, Selama and Larut Matang.

Under the Standard Operation Procedure [ SOP ] issued by National Safety Council, we fall under the essential services. Therefore, law firms in the said districts are allowed to operate. However, we urge members to take safety precautions and follow the SOP at all times. 

1. LOWER COURTS

We have confirmation that lower courts in the said districts are closed during the EMCO period. Members are not required to attend Court for their cases except for those who are involved in remand proceedings, fresh charges in criminal courts and matters involving a certificate of urgency. Trials and case managements before the Magistrates and Sessions Court Judges are vacated. Members are advised to opt for proceedings via email, e-review and online hearing. All case managements already set via e-review will proceed as scheduled. Service counters are also closed during this period.

Please take note that courts outside the EMCO area will operate as usual. 

1. HIGH COURTS

In respect of the High Court in Ipoh and Taiping, no physical attendance is needed.  For matters which are fixed before the Judge, the respective officers will inform you whether it will proceed via online or if it is to be rescheduled. Members are advised to keep track of the same via the e-filing system.

Meanwhile, all 24FC, 24MFC 38, 29NCC, 31NCVC and 32NCVC (fresh case) code cases before the Registrars will be rescheduled. For ex-parte and non-contested interlocutories before Registrars , the matters will proceed via online (exchange of email, e-review or zoom).

We have been informed by the Deputy Registrar,  Puan Zulyana Binti Zollkapli that there the above arrangements may be changed subject to any directives from Palace of Justice. We will notify all members, if there are any changes as soon as possible.
