RE : (Part 1) TRIALS/ HEARINGS DURING CMCO ; 2) INDUSTRIAL COURT’S CMCO DIRECTIVE

Dear Members of the Perak Bar and Pupils in Chambers,

 

 

We hope this finds you all in the pink of health and at the same time, everyone is adhering to the SOPs in the strictest sense (so that the earlier part of this sentence can remain true).

In reference to the circular issued by our Perak Bar Chairman dated 8.11.2020, we would like to add on and clarify that upon reconfirmation from the Perak Courts, all trials and hearings set during this CMCO period shall not proceed, even if all parties (Judges, Magistrates, lawyers, witnesses, etc) are willing to attend and proceed with the said trial/hearing. It is hereby confirmed that it is not an option to proceed with the matter and if any court does give out such directives/instructions, kindly do inform us of it.

On another note, the Industrial Court has informed us that all mentions and trials/hearings set during this CMCO period are to be vacated. However the IR Court registry is open from 8.00-4:30 PM during weekdays to accept filing and service of documents. Members are hereby advised to contact the IR Court to set the new mention/trial dates (similarly done with the conventional courts).
