Circular To Perak Criminal Practitioners,
RE: REQUEST FOR FEEDBACK ON ANY ISSUES ENCOUNTERED IN RELATION TO NOTES OF EVIDENCE IN CRIMINAL MATTERS
We refer to the above matter and an email we have received from the Criminal Law Committee indicating that the Y.A.A. Hakim Besar Malaya intends to convene a discussion session concerning issues relating to the preparation of Notes of Evidence in criminal cases.
As such, we invite members of the Perak Bar to provide feedback on any issues encountered in relation to Notes of Evidence in criminal matters, including but not limited to:
* Delays in the preparation or provision of Notes of Evidence;
* Difficulties in obtaining certified copies;
* Issues relating to the accuracy or completeness of Notes of Evidence or transcripts;
* The impact of such issues on appeals, case management, or the conduct of proceedings; and
* Any suggestions for improving the current process.
Members are encouraged to provide specific examples based on their experience where possible. This may include details such as:
* The court involved;
* The nature of the issue encountered;
* The approximate time frame involved;
* The impact of the issue on the conduct of the matter; and
* Any practical recommendations for improvement.
Kindly submit your feedback by 10 June 2026, Wednesday to enable the Criminal Law Committee to compile and present the views of practitioners during the discussion session.
