RE: DIVORCE PROCEEDINGS UNDER CODE 33JP AND 24F IN HIGH COURT IPOH AND TAIPING

We refer to the above matter.

The Perak Bar Committee has received a notification from the Deputy Registrar of the High Court Ipoh that all Joint Petition divorce proceedings under Code 33JP and Originating Summons under Code 24F [Application for Exemption from referral to Badan Pendamai (Conciliatory Body) / Tribunal Perkahwinan (Marriage Tribunal)] filed with effect from 15^th of July, 2025 in High Court Ipoh will be heard before the Judge of the Sessions Court, namely Ybrs. Tuan Meor Sulaiman bin Ahmad Tarmizi by way of physical hearing.

Also, we found out from the Deputy Registrar that for similar matters filed in High Court Taiping with effect from June, 2025 will be heard by either Ybrs. Puan Nabisha binti Ibrahim or Ybrs. Puan Ruzaimah binti Mohd Ridzwan by way of physical hearing.

Kindly take note that, despite the changes the aforesaid applications must still be filed in the respective High Court Registries and it will then be assigned to the respective Sessions Court Judges for hearing. Also to avoid complications when filing the Petition under Code 33JP or the OS under Code 24F do not pray for orders which falls under other Codes as they will fall under the jurisdiction of the Judges of the High Court .

Also take note that the aforesaid changes were made under powers conferred by section 2[2] of the Law Reform [Marriage and Divorce] Act 1976 [Act 164] and under Arahan Amalan Hakim Besar Malaya Bil. 2 Tahun 2020 and it was gazetted on 25^th March 2025 under the heading “Notification of Conferment of Jurisdiction to Sessions Court Judge 2025” [P.U.(B) 125].
